Terms and Conditions
Legal information
We are Fresh Farm, a company registered in Italy. The address of our head office is via San Michele, 121 - 41049 Sassuolo (Modena), Italy.
 
These are the terms and conditions that apply when you shop with us (or access our services, Apps and sites (our "Sites")). They are important to both us and you, as they set out what we can expect from each other and also provide you with useful information. You can find more information in the About section of the site (which is also part of these terms). Should you need it, you can contact Customer Support, we are always happy to talk to you!
 
We do update these terms and the Help section of the site from time to time, so remember to check before you make a purchase as we will always consider the latest update.
 
As for you
To shop with us you must:
 
be at least 16 years old;
be in possession of a credit or debit card belonging to one of the circuits we accept (check the end of the page for details of the providers we currently accept);
be authorised to use that credit or debit card (the card is in your name or you have permission to use it
 
 
Placing an order
 
After making a purchase, you should receive an email confirming that we have received your order. We then carry out standard checks to ensure that there is sufficient funds on your selected card/payment method.
 
We will only accept your order once your payment has been approved and your card/account debited (at which point the contract is concluded based on these terms).
 
You may be able to cancel (not modify) your order within a short period of time after placing it: the timeframe will depend on the shipping method selected (and will be indicated in the confirmation email). You cannot modify your order, you will have to cancel it (and/or return the item(s) purchased with your original order) and place a new order.
 
All orders are subject to availability and confirmation of the order price. Don't worry, if there is a problem with an order, we will contact you directly.
 
In rare cases, we may have to refuse or cancel an order or block an account (even if the order has been previously confirmed), for example if we notice something particularly unusual about an order or account or if your order exceeds the limit of units allowed as detailed on the product pages of specific items. If this happens to you and you think there's been a mistake, please don't take it personally - contact Customer Service and we'll be happy to help.
 
Prices and product descriptions
At Fresh Farm headquarters we are always buzzing and sometimes it can happen that one of our Fresh Farmers enters an incorrect price or product description/promotion. If we notice an error on one of the items you have ordered, we will notify you as soon as possible and give you the option of reconfirming your order (at the correct price) or cancelling it.
 
If we are unable to contact you, we will have to cancel your order. If your order is cancelled after payment has been made, we will refund the full amount paid.
 
Prices include VAT (where applicable).
 
Depending on the value of your order or the shipping method or delivery address selected, you may be charged shipping costs (see below). These additional costs will be clearly visible at checkout and included under 'Total Cost'.
 
Promotions
We reserve the right to apply temporary promotions to certain products, even without prior notice. There are no refunds for material purchased immediately before the start or immediately after the end of a promotion.
 
Deliveries
Before completing your order, you will be presented with several shipping options to choose from, all with an estimated delivery date depending on your address.
 
We do our best to meet the estimated delivery time, but sometimes delays may occur due to courier circumstances, logistical issues or adverse weather conditions. We will do our best to provide timely updates and it should still be possible to track the progress of your parcel in these cases.

Returns and refunds
Please see the full version of our returns and refunds policy.
We will not accept returns received after the deadline, without labels, receipt and undamaged original packaging.
 
Do you want to return an item to receive a refund?
 
We know, sometimes an item received is not perfect for us and all we want is to receive the amount spent back. Don't worry, as long as the item is still in its original condition, we accept item returns at no extra charge.
 
In the case of an item being returned within 30 days of the day the package was delivered or was available for collection, the full amount paid for the item will be refunded to the same payment method used to place the order unless you specifically request return services, the cost of which will be deducted from the refund amount.
 
We undertake to refund you within 14 days of receipt of the item at our warehouse.
 
If you intend to request a refund within the above time periods but are unable to make the return for some reason, please contact us bearing in mind that in this case the refund will be at our sole discretion.
 
 
 
What about after the required timeframe?
 
We do not accept returns of unwanted items returned after the above time periods. If you send a return after the required time frame, we may have to return it to the sender and ask you to cover the shipping cost.
 
 
 
Shipping receipt
 
We strongly recommend that you request and obtain a return shipping receipt. All returns are subject to the Fresh Farm return policies outlined on the appropriate pages. The address of our warehouse is as follows:

Hygienic conditions
 
 
Hygiene and safety, yours and that of all our customers, are paramount and for these reasons some products cannot be returned, including:
 
Face and body products that have been opened, used or have a damaged safety seal
Underwear and swimwear from which the protective adhesive strip or hygiene seal has been removed
None of these rules affect your statutory rights.
 
 
 
Original conditions
 
All returned items must be returned new, in their original condition together with their original packaging and with all Fresh Farm or other brand labels.
 
Footwear - Only try footwear on carpet or rugs to protect the soles. They must also be returned with the original box and any bags received.
 
Returned items are thoroughly checked once received at the warehouse. Of course, it is perfectly fine to try on an item as you would in a shop, but we kindly ask you not to wear it any longer. When trying on a new item it is important to use caution (do not use excessive force on zips and seams) and not to wear make-up, perfume or deodorant as these can leave stains and odours on the item.
 
If an item is returned damaged, with signs of use, in an unsuitable condition to be sold or in any case where the instructions above have not been followed, a refund will not be possible and we may have to send the item back (and ask you to cover the cost of shipping).
 
None of these rules affect your statutory rights.
 
 
 
Consistent use
 
In case of unusual and non-consistent return activity, e.g. if there is a well-founded suspicion that the items are actually worn before being returned or if the number of returns is too high (much, much higher than what even our most loyal customer could normally achieve or if the returned items do not correspond to those ordered), we may have to take the decision to deactivate an account and all possible accounts associated with it. Should this happen to you and you feel that an error of judgement has been made, please contact Customer Support and we will be happy to review your case.
 
If your account has been deactivated and you need to make a return, please contact Customer Support and they will provide you with a return label but in this case you will be responsible for the shipping costs.
 
Please note that we reserve the right to take legal action if returned items do not match those ordered.
 
This regulation does not affect your statutory rights.
 
Discount Codes
From time to time we may offer you a Discount Code that you can use to reduce the price of certain items. Remember that it is up to you to enter the code at checkout!
 
Here are some important things to keep in mind:
 
Each Discount Code has its own terms that will be clearly stated when the code is issued (e.g. which items, single/multiple use, when it can be used, etc.).
 
Unless otherwise stated by us, Discount Codes cannot be used to purchase Fresh Farm Gift Vouchers or on Travel Farm.
 
If you are given a unique Discount Code intended only for you (e.g. a Discount Code for an event), please keep it to yourself, do not share it with anyone and do not abuse it (e.g. post it on social media). If we think you are abusing or have abused a Discount Code in the past in any way (e.g. by selling it or sharing it with others), we may cancel your Discount Code and/or suspend or even close your account without telling you.
 
We don't like to take these measures, but if a Discount Code is not working properly because someone or something is spoiling the fun for everyone - for example in the case of fraud, tampering, technical errors or any other situation which is beyond our control and which affects the operation or correctness of the Discount Code - we may cancel, modify or suspend the Discount Code.
 
Gift Vouchers and Gift Cards
If you are lucky enough to receive a Fresh Farm Gift Voucher, here are some important things to keep in mind:
 
The best thing to do is to save your Gift Voucher code as soon as possible to keep it safe.
 
Gift Vouchers and Gift Cards cannot be used to purchase other Fresh Farm Gift Vouchers or on Travel Farm.
 
If you are feeling generous and decide to buy a Fresh Farm Gift Voucher for someone, make sure you have the correct email address! If you enter the wrong email address and the code is used by someone else, we won't be able to help you. Please check again before completing your purchase.
 
Speaking of email, sometimes those pesky (but useful) spam filters send our emails to the spam folder. So, if your friend is late in thanking you for your generous gift, you might want to ask them to check, just in case something wonderful is waiting to be discovered in the spam folder!
 
Gift Vouchers purchased on the site will expire 2 years after the date of receipt.
 
Fresh Farm reserves the right to cancel any Gift Voucher, at its sole discretion, in case of suspected fraud or misuse.
 
Your data
Our Privacy Policy explains how we will use your data. If your details change, remember to update the My Account section so we can continue to offer you our best service (you can also update your marketing preferences here).
 
Here at Fresh Farm, we love being able to interact and chat through social media. However, we are unable to control the various social media platforms, or the way you set up your profile on these platforms. Please check and set your privacy preferences so that you are happy with how your data will be used on those platforms.
 
What you shouldn't do...
We know it goes without saying, but you should not abuse or tamper with our sites, Apps or other services (e.g. hack, introduce viruses, Trojans, worms, logic bombs or other technologically harmful materials or perpetrate attacks aimed at denial of service, etc.) or otherwise tamper with our technical features or steal our customers' data. These can be considered criminal offences and, moreover, affect our ability to offer the best possible service to Fresh Farm's loyal customers and, therefore, are things we take very seriously. Fresh Farm will report any of these violations or activities (and all information about the people who committed them) to the appropriate authorities.
 
We recommend that you use virus protection software when using any site, including ours. Although we have a dedicated team working hard to prevent anyone from tampering with our site, we cannot guarantee that it will always be protected from bugs, viruses or any troublemakers.
 
Furthermore, you are not allowed to use automated systems or software to extract data from our Site ('screen scraping').
 
Jammers, take note: You agree to indemnify, defend and hold Fresh Farm, its directors, officers, employees, consultants, agents and affiliates harmless from any and all third party claims, liabilities, damages and/or costs (including, but not limited to, legal costs) arising out of your use (or misuse) of this Site or your breach of the Terms and Conditions of Use.
 
Intellectual property, software and content
Fresh Farm owns or has permission to use the intellectual property rights in its Site and its content. These rights are protected worldwide. All these rights are reserved.
 
You are permitted to store, print and view the contents of our Site solely for your personal use. You are not permitted to use any part of the site for commercial purposes without our express permission.
 
In addition, you are not permitted to use the Fresh Farm logo, or any other Fresh Farm brand or trademark (or any symbol having similar colours) without our express permission.
Links to the Site
You may link to Fresh Farm.com as long as you do so without commercial purposes and in a fair and legal manner and without damaging or taking advantage of our reputation.
 
Please do not link in ways that suggest any form of approval or endorsement by Fresh Farm, if this has not been given to you.
 
Our Site must not be placed on any other site without our permission.
 
Do you have a complaint or need to talk to us?
Sometimes incidents occur and you may need to speak to us. In these cases, please contact Customer Support and the team will help you resolve any issues you may have with our services. You can contact us by email at info@freshfarm.it, and by using the whatsapp button on the homepage.
 
Legal notice
We have the right to modify, remove or change our services and/or any part of the Website (including our Terms and Conditions of Use) at any time.
 
These terms and our relationship with you are subject to English law and the exclusive jurisdiction of the English courts.
 
Terms and Conditions of Use of User Generated "Content
Have we contacted you via social to submit your content on one of our social channels?
 
Congratulations! It means we like your style.
 
By giving you the opportunity to submit your content on our social channels and responding with the requested hashtag you agree that:
 
we may use your username/nickname and your content (the "Content") on Fresh Farm.com and/or any other Fresh Farm social platforms (including but not limited to Instagram, Facebook and Twitter);
we may edit, trim, adapt, enhance or modify the Content (provided that Fresh Farm will not treat the Content in a disrespectful manner).
You warrant that:
 
you have the consent of anyone portrayed in the Content;
you are entitled to grant Fresh Farm the rights referred to in the preceding paragraph;
you are at least sixteen years of age.
If you (or anyone else portrayed in the Contents) ask us to remove the Contents, we will remove them from the social profiles we manage.
 
You are aware that other users of the social platforms may share or make use of the Content once it is posted. In particular, a user of the relevant social platforms may take a screenshot of the Content and save an image of the Content to their device, share the Content on social platforms or websites that feature the Content (and have sharing capabilities). If you do not want to consent to the above, please do not give us consent to use the Content.
